Do I Have a Claim?
The short answer is YES! – if you’ve been injured or suffered a loss in an accident that wasn’t your fault. Of course every accident is different and you’ll need advice as to how you should go about dealing with your accident claim.  The general rule is that if you have been involved in an accident the start position is that you do on the face of it have a claim.

The real question is – will I win?
The law is there to prevent individuals from being in accidents in the first place and if an accident has happened the law is also there to compensate the injured party and sometimes penalise the responsible party.  You can claim for almost any type of injury that you have suffered as a result of somebody else’s fault.  If you have already spoken to a Solicitor who was not that optimistic about your claim you should nevertheless get a second opinion because Solicitors specialise in different areas of law even in the accident compensation field and you may have spoken with a Solicitor who did not have particular expertise in the area of accident claim that you have been involved in.

For example if you have suffered a slip and fall or slip and trip accident and you have spoken to a Solicitor who deals with road accident claims you may not have been properly advised . Do I have someone to sue and if so is it worth suing them?

It is all very well having suffered an injury as a result of somebody else’s fault but we need to make sure (and this is part of your Solicitors job too) that we not only identify the responsible party but also work out whether that Defendant has got insurance to meet the claim, especially if the Defendant is a man of straw, and also we correctly identify and locate the Defendant.  By way of example it is very sad when somebody suffers a dog biting attack and we are very keen to try and help that client.  If the client  was attacked by a stray dog without any apparent owner it is close to impossible to succeed in the claim for the accident victim. Similarly if someone has been attacked by a dog and we know who the owner is but they are poor and for example live in Council accommodation and they have no insurance then there’s no real point in acting for a client and suing that person because any Judgment obtained is unlikely to be satisfied. However, these are issues for the solicitors  to decide and we would rather you contact us and then we can advise you accordingly and without any charge.

Getting the Evidence (On the circumstances)
After you’ve had an accident and instruct us we’ll send the case to the most appropriate specialist accident solicitor who has experience in dealing with your type of claim. The evidence gathering process will commence immediately and your solicitor will request appropriate documentation depending on the type of accident you have been involved in.  Such documentation may for example include a Police accident Report Book, letters and wage slips from Employers, instructing an Automotive Engineer (looking at the impact damage on a vehicle for example), requesting information from lay witnesses … the list of evidence gathering goes on. However it is all with the aim of disclosing to your opponent and his insurers with a view to establishing or proving  liability rests with the defendant  Once liability has been resolved your solicitor will move on to the next evidence gathering stage.

Medical and Other Evidence on Value

Once your Solicitor is getting on with the evidence gathering on liability even though all that evidence is not yet to hand if your Solicitor is satisfied that you will win the case (which is often based on your initial instructions to him) he may well arrange for you to be medically examined and that a medical report be obtained to support your claim for the injuries you have suffered.  It is crucial that documentary evidence is obtained in connection with all the losses you have suffered and a medical report is critical if you suffered an injury.  If your vehicle has been damaged then an Engineers report showing the extent of the damages is also required.
