No Win No Fee Accident Compensation

The Law

Essentially, there are 3 elements to proving any claim in negligence and these are as follows: -
1. Duty of care
If we can show that our client has suffered an injury which (from a common sense point of view) ought to have been somebody else’s responsibility for making sure that they did not injure our client and our client has been injured, and then we’re over the first hurdle here. In other words, if your wheel falls off your car after being serviced and you suffer an injury, the mechanic who services your car is said to have owed you a duty of care (to service the car properly) and so you may have a claim against him.
2. Breach of Duty
If we can show that a person that owes our client a duty of care has broken that duty of care by acting negligently or recklessly then we’ve overcome the second hurdle so in the example of the car mechanic not fastening the wheel on to the car properly, at face value it seems that the mechanic has broken his duty of care to our client by not fastening the wheels onto the car properly.
3. Resultant Damage
If we can show that our client suffered damage or injury as a result of the accident and on the basis that 1. the duty of care has been owed and 2. there has been a breach of that duty of care then 3. our client will be entitled to claim for all the resulting damages and injuries. So, in the example of the mechanic not fixing the wheel onto the car properly if the worst that has happened is that the wheel has fallen off and no one was injured and there is no damage to the car, then there is no claim BUT if as a result of the mechanic’s breach of duty of care to the client, the wheel fell off and our client crashed the car causing injury and loss to the client, then the client is entitled to submit a claim against the car mechanic or his employers or his insurers. All the injuries and losses that flow from that breach of duty/negligence are claimable.
